Refund And Bankruptcy Claims Against New Fitness For Women

The Virginia Department of Agriculture and Consumer Services (VDACS) has set October 11, 2006 as the deadline for eligible former members of the Brambleton Avenue location of New Fitness for Women to file claims for refunds of the unexpired portion of their health spa contracts.

New Fitness for Women, located at 3953 Brambleton Avenue , Roanoke , Virginia , closed permanently on May 18, 2006 . According to the Virginia Health Spa Act, contracts held by the spa’s former members were terminated automatically when the Brambleton Avenue location went out of business and did not provide a comparable alternate facility for members to use.

The VDACS Office of Consumer Affairs (OCA) will provide pro rata refunds to eligible members from the surety required by the Health Spa Act for the protection of the spa's contract-holders. OCA must receive all refund claims by 5 p.m. on October 11, 2006 .

Former members of the Brambleton Avenue location of New Fitness for Women who believe they are due a refund should contact OCA to file for any refund due. Once all claims are filed, OCA will calculate individual refunds based on the total value of claims filed.

Fitness & Wellness Solutions, Inc., the owner of New Fitness for Women, has filed for Chapter 11 bankruptcy protection. As potential creditors in the bankruptcy, former members of the New Fitness Brambleton Avenue location are entitled to protect their rights by filing a proof of claim with the Bankruptcy Court.
