Domestic Support Obligations

Domestic Support Obligations include child support and alimony and any other debt that is owed to a debtor's spouse or former spouse, child, or government unit to alimony, maintenance or support. Domestic support obligations are among the items that can not be dismissed in a bankruptcy case. A debtor with domestic support obligations is still required to keep up with and pay these obligations regardless of his or her bankruptcy status. Domestic support obligations are also not covered by any type of automatic stay which puts certain debts on hold during a bankruptcy proceeding, barring creditors from collecting on a debt. Domestic support obligations are a different type of debt, and some might say they are an essential debt, and therefore they can not be dismissed.
