Can bankruptcy get rid of credit card debt legally?

Can bankruptcy get rid of credit card debt legally? Can the credit card companies come after me later?

Answers

Yes, once your bankruptcy case has been completed, all your credit card debt will be discharged, meaning it's gone forever. Additionally, once a bankruptcy petition has been filed, your creditors are immediately barred from contacting you in any way to attempt to collect on debt. Now, in your first bankruptcy hearing, some creditors may try to motion for the court to remove the "automatic stay" and allow them to collect their debt, but your attorney can usually easily combat this. That bankruptcy laws are on your side, and if you have a competent attorney representing you, then you should be fine.

That being said, there are some consequences of bankruptcy, most notably a hit on your credit score, but in reality you should be able to get credit again within a few months of completing your case.

Talk to a Bankruptcy Lawyer to get a consultation where you can get good legal and financial advice to find out if bankruptcy is a good option for your situation.
