Can I file for bankruptcy without affecting my wifes credit in New Jersey?

I am married to my spouse and most of my credit cards only in my name have been in collections, surpassing $15,000. Can I file bankruptcy without affecting my wife’s credit at all? I live in the state of New Jersey.

In general, the only way it could possibly affect the former spouse's credit is if you are including debt in your bankruptcy that you spouse may be jointly obligated on. In most cases, if the spouse was not a co-signer on any of the debts you file bankruptcy on, then they won't be affected.

There may be certain nuances specific to your state that you should explore. Moving forward, please consult a Bankruptcy attorney to determine the proper course of action.
